Who we are. Momentum Training is operated by David Coyne, trading as Momentum Fitness
(ABN 55 038 736 194), based in Victoria, Australia (“we”, “us”, “our”). Contact details are at the end of this page.
These terms cover your use of the Momentum Training app, where your coach writes your program and you log your training, food and progress. Your coaching itself (sessions, fees, cancellations) is covered by the training agreement you sign with us. If the two ever disagree about your coaching, the agreement wins.
1. Your account
Your coach invites you, and your account is for you alone. Keep your password to yourself, and tell us straight away if you think someone else has used your account.
If you’re under 18, a parent or guardian must agree to these terms and to our privacy policy for you (see §9 of the policy).
Coach accounts must also use two-step sign-in, a code from an authenticator app, because they open clients’ health records.
2. Your health
Tell your coach about any injury, illness or medical condition before you start, and fill in the pre-exercise questionnaire honestly. If there’s any doubt about your readiness to exercise, get clearance from your doctor first.
The app, your program and anything your coach writes are coaching, not medical advice. Nutrition guidance, targets and meal suggestions are general information, not advice from a dietitian.
Stop and tell your coach if anything hurts. Physical training carries a risk of injury, and you take part voluntarily.
Numbers the app works out for you (loads, estimated maxes, calorie and macro targets, body-composition estimates) are estimates to guide your training, not measurements you should rely on for anything else.
3. Using the app
Use the app for your own training. Don’t try to get into anyone else’s account or data, interfere with how the app works, or copy the app or your program to build or sell something else.
What you log should be honest: your coach makes decisions from it.
The app works offline in the gym and sends what you logged when you’re back online. We work hard to keep it running, but we can’t promise it will always be available or free of errors. If something you logged doesn’t appear, tell your coach.
4. Board, your coach’s client community
Board is optional. If you join, be respectful: no harassment, hate, sexual content, spam or advertising, and don’t share anyone else’s information or photos without their permission.
Your coach can hide or remove anything posted there and can remove anyone from Board. You can block another member and leave Board at any time.
Board isn’t available to anyone under 18. What happens to what you share there is in §4A of the privacy policy.
5. Your information and our app
What you log and upload stays yours. You let us store and use it to coach you and run the app, as the privacy policy describes. You can export it from Settings and ask us to delete it (how).
The app, its programs, exercise library and written content belong to Momentum Fitness. You can use them for your own training while you’re a client.
Connected apps and wearables (such as Strava, Whoop or Withings) have their own terms, which apply when you connect them.
6. Payments
Fees, cancellations and refunds for coaching are set out in your training agreement and summarised on Payments & refunds. Card and direct-debit payments are processed by Stripe; we never see or store your full card or bank details.
7. Ending your use
You can stop using the app at any time and delete your account from Settings (details). We may suspend or close an account that breaks these terms or when your coaching ends; if we do, you can still ask us for a copy of your data.
8. Your consumer rights and our liability
Nothing in these terms limits, excludes or modifies any guarantee, right or remedy you have under the Australian Consumer Law that can’t lawfully be excluded or limited.
Where the law allows, our liability for anything that isn’t a consumer guarantee is limited to supplying the service again or paying the cost of having it supplied again, and we aren’t liable for indirect loss.
9. Changes
We may update these terms as the app changes. We’ll change the date at the top, and tell you in the app or by email before a change that affects you significantly takes effect.
10. Law
These terms are governed by the laws of Victoria, Australia.
